Jabulani Khumalo
Cape Town – Jabulani Khumalo, the founder of the uMkhonto weSizwe Party (MK Party), has lost his urgent request to the Western Cape High Court to be sworn in as a Member of Parliament (MP) on Thursday. The court concluded that Khumalo failed to demonstrate the urgency of his case, resulting in the matter being struck from the roll.
Khumalo’s plea to the court comprised a request for provisional access to Parliament on Friday, pending a secondary application to evaluate the legitimacy of his expulsion from the MK Party. Additionally, he sought to prevent the MK Party, former President Jacob Zuma, or any associates from removing his name as a member of the National Assembly.
The recent turmoil follows Khumalo’s removal from the top candidate position in the MK Party’s list for Parliament. This change was instituted after the party informed Parliament that Khumalo was no longer a party member.
In a related development, the Electoral Court dismissed a claim from Khumalo on Wednesday, which challenged his removal as the party leader. Khumalo argued that his expulsion did not adhere to due process requirements.
Legal Battles
In his ongoing legal battles, Khumalo’s name was initially on the forefront of the list submitted to Parliament by Chief Justice Raymond Zondo, as per the Electoral Commission’s receipt last week. Despite this, Parliament removed him from the list based on correspondence from the MK Party.
MK Party’s Political Turmoil
The party’s leadership has expressed readiness to boycott the swearing-in ceremony of its 58 candidates until the courts address their electoral concerns.
Defamation Accusations from Duduzile Zuma-Sambudla
Duduzile Zuma-Sambudla, daughter of former President Jacob Zuma, has also made headlines with a stern statement against Jabulani Khumalo. Zuma-Sambudla accused Khumalo of committing perjury, alleging that he falsely claimed she forged his signature.
“I am pleased with the recent decision of the Electoral Court, which has dismissed the unfounded allegations against me by Jabulani Khumalo, affirming my integrity and the malicious nature of the accusations made. The court has categorically rejected Jabulani Khumalo’s claim that I forged his signature, establishing that such allegations were not only baseless but constituted a deliberate act of perjury,” Zuma-Sambudla stated.
She further added that she is in consultation with her legal team to initiate defamation proceedings against Khumalo, asserting that his actions were aimed at tarnishing her credibility and that of the MK Party.
