A group of U.S. lawmakers has called on President Donald Trump to revoke South Africa’s preferential trade benefits under the African Growth and Opportunity Act (AGOA). The legislators cite alleged human rights abuses, particularly concerning land expropriation policies, and South Africa’s foreign policy decisions as grounds for this action.

Allegations of Human Rights Violations

The primary concern expressed by the U.S. lawmakers revolves around South Africa’s Expropriation Act 13 of 2024. This legislation enables the South African government to seize agricultural property from ethnic minority Afrikaners without compensation. Critics argue that this policy mirrors historical injustices and undermines property rights, leading to potential economic instability. The U.S. Congress members contend that such actions violate the eligibility criteria of AGOA, which mandates beneficiary countries to uphold the rule of law and respect for human rights.

In a letter dated 11 February 2025, six Republican members of the House of Representatives urged President Trump to take decisive action. They described the South African government as an “ethnonationalist gangster regime” and accused it of pursuing policies reminiscent of “Mao’s destructive land reform.” The letter emphasized that Pretoria’s actions constitute a likely violation of 19 U.S.C. 3703, which outlines the requirements for countries to benefit from AGOA. 

Foreign Policy Concerns

Beyond domestic policies, South Africa’s international alignments have also drawn ire from U.S. legislators. The country’s decision to pursue a genocide case against Israel at the International Court of Justice (ICJ) has been particularly contentious. Initiated in 2023, the case accuses Israel of committing genocide during its military operations in Gaza—a charge that Israel vehemently denies. In response, President Trump halted aid to South Africa and threatened to revoke its AGOA benefits, asserting that such actions undermine U.S. foreign policy interests. 

Additionally, South Africa’s strengthening ties with nations like China and Iran have raised concerns in Washington. The U.S. administration alleges that South Africa is collaborating with Iran on military and nuclear matters, a claim that South African officials deny. These alliances are perceived by some U.S. policymakers as antagonistic to American interests and global security.

Potential Economic Implications

The revocation of AGOA benefits could have profound economic repercussions for South Africa. AGOA, enacted in 2000, provides eligible sub-Saharan African countries with duty-free access to the U.S. market for thousands of products. South Africa has been one of the significant beneficiaries, with sectors like agriculture and manufacturing reaping substantial gains.

Analysts warn that losing AGOA benefits would severely impact South Africa’s economy, particularly its agricultural sector. Exports such as citrus fruits, wine, and automotive components could face increased tariffs, making them less competitive in the U.S. market. This potential loss of market access could lead to job losses and decreased foreign exchange earnings, exacerbating existing economic challenges. 

South Africa’s Response

In light of these developments, South African President Cyril Ramaphosa has maintained a defiant stance. He asserts that the Expropriation Act is a constitutional measure aimed at addressing historical land injustices and promoting equitable access to resources. Ramaphosa emphasizes that the policy is not racially motivated and seeks to rectify disparities stemming from the apartheid era. He has also expressed a willingness to engage in dialogue with the U.S. to clarify the objectives and implementation of the land reform policy. 

Regarding foreign policy, South Africa’s government remains steadfast in its decisions. Officials argue that pursuing legal action against Israel at the ICJ aligns with the country’s commitment to human rights and international justice. They also contend that maintaining diplomatic relations with a diverse range of countries, including China and Iran, is within their sovereign rights and serves national interests.

Broader Diplomatic Ramifications

The call to revoke South Africa’s AGOA benefits is indicative of broader geopolitical shifts and the complexities of international alliances. The situation underscores the delicate balance countries must navigate in aligning domestic policies with international expectations.

For the United States, this move reflects a broader strategy of leveraging economic tools to influence foreign policy and promote human rights. However, such actions also risk straining relations with key African partners and could have unintended consequences on regional stability and economic development.
