The National Assembly on Tuesday passed several important Bills, each aimed at addressing different issues facing the country.

 

The Bills passed include the National Prosecuting Authority Amendment Bill, the Prevention and Combating of Hate Crimes and Hate Speech Bill, the Independent Police Investigative Directorate Amendment Bill, the National Youth Development Agency Amendment Bill, and the Preservation and Development of Agricultural Land Amendment Bill.

These Bills were passed during the House’s plenary sitting, signifying a significant step forward for the country in various areas.

## National Prosecuting Authority (NPA) Amendment Bill

The NPA Amendment Bill is a crucial step towards enhancing the National Prosecuting Authority’s independence and ability to prosecute high-level crimes. The Bill establishes the Investigating Directorate against Corruption (IDAC) as a permanent entity within the NPA and provides for the appointment of permanent investigators. This move will ensure that the NPA has greater investigative capacity and capability, particularly in the probing and prosecuting of high-level and complex crimes of corruption in the country. The Bill also establishes an appeals mechanism through the appointment of a retired judge, further strengthening the NPA’s independence. The passing of this Bill is a significant milestone in the fight against corruption.

## Independent Police Investigative Directorate (IPID) Amendment Bill

The IPID Amendment Bill seeks to ensure the independence and impartiality of the Independent Police Investigative Directorate. It provides that the Directorate must exercise its powers and functions without fear, favour, prejudice, or undue influence. The Bill also proposes that the IPID executive director be appointed by the Minister of Police, with the concurrence of Cabinet, for a non-renewable period of at least seven years and not longer than 10. This move will ensure that the IPID operates independently and has the necessary authority to investigate police misconduct and abuse of power.

## Prevention and Combating of Hate Crimes and Hate Speech Bill

The Prevention and Combating of Hate Crimes and Hate Speech Bill marks a significant step towards the protection of all people in South Africa against hate crimes and hate speech. The Bill defines hate crimes as offences committed where the offender is motivated by prejudice or intolerance towards the victim because of specified characteristics. These characteristics include age, albinism, race, religion, sexual orientation, and more. The Bill also defines hate speech as the intentional publishing or communicating of anything that can incite harm or promote hate based on specified grounds. It provides for penalties such as fines, imprisonment, or both for those convicted of these offences. The passing of this Bill reflects the country’s commitment to combating hate crimes and hate speech and protecting the rights of all citizens.

## National Youth Development Agency Amendment Bill

The National Youth Development Agency Amendment Bill seeks to amend the National Youth Development Agency (NYDA) Act of 2008 to address various issues related to the functions and governance of the NYDA. The Bill provides for the inclusion of additional NYDA Board members and sets term limits for their tenure. It also requires the submission of financial disclosures by Board members and seeks to amend matters pertaining to the meetings of the Board and the funding of the Agency. The passing of this Bill is an important step towards strengthening the NYDA and ensuring its effectiveness in addressing the needs of the country’s youth.

## Preservation and Development of Agricultural Land Amendment (PDAL) Bill

The PDAL Bill seeks to address the shortcomings of the Subdivision of Agricultural Land Act (SALA) of 1970 by facilitating cooperative governance in the administration of the Act. It also aims to address other identified weaknesses, such as the fact that SALA is only applicable to privately owned land, which prevents the protection of high-value agricultural land owned by the state and other entities. The Bill intends to harmonise the use of agricultural land for agricultural purposes and non-agricultural uses in line with local authorities’ spatial planning. This Bill represents an important step towards ensuring the sustainable use and development of agricultural land in the country.
