Stuart James Scharnick has officially opened cases of perjury and defamation of character against Lieutenant-General Dumisani Khumalo, the head of Crime Intelligence.
Scharnick alleges that Khumalo made false and harmful statements about him during his testimony at the Madlanga Commission last week.
The cases were filed at the Pretoria Central Police Station on the morning of 12 November 2025. This legal action stems from Khumalo’s claims that suspended deputy police commissioner Shadrack Sibiya was seen driving a vehicle registered to Scharnick, who reportedly has 34 criminal cases on record, on numerous occasions.
Scharnick, described as an associate of Sibiya, strongly denies the accusations and has taken swift steps to challenge them in court. The move highlights growing tensions in the ongoing commission probe into police corruption and interference, where personal reputations are increasingly at stake.
Background to the Madlanga Commission and Khumalo’s Testimony
The Madlanga Commission, established to investigate allegations of corruption and criminal infiltration within Gauteng’s law enforcement, has heard explosive evidence from various witnesses. During his appearance last week, Khumalo detailed concerns about Sibiya’s associations, including his use of Scharnick’s vehicle. Khumalo suggested this link raised questions about Sibiya’s integrity, given Scharnick’s alleged criminal history spanning multiple cases.
Khumalo’s testimony was part of broader revelations about potential criminal networks within the police, including ties to figures like Vusimuzi “Cat” Matlala. He emphasised that such connections could compromise investigations and public safety. However, Scharnick contends these statements were not only untrue but deliberately damaging to his character.
The commission has already led to suspensions and further probes, with Khumalo’s evidence drawing particular attention for its direct accusations against high-ranking officials.
Scharnick’s Response and Denial of Allegations
Scharnick has vehemently denied any wrongdoing or improper association with Sibiya. In statements following the testimony, he labelled Khumalo’s remarks as defamatory and a misrepresentation of facts. He argues that the general’s claims were made without evidence and have caused irreparable harm to his reputation.
By filing perjury charges, Scharnick alleges that Khumalo knowingly provided false information under oath, which could carry severe penalties if proven. The defamation claim seeks to address the public damage, potentially including compensation for lost opportunities or emotional distress.
Scharnick’s legal team has moved quickly, opening the docket at Pretoria Central, indicating a determination to clear his name through the courts rather than public exchanges.
