The National Prosecuting Authority (NPA) spokesperson Henry Mamothame confirmed the State is ready to proceed with the trial against Sibusiso Kula the African National Congress (ANC) Member of Parliament (MP) who is accused of killing his wife, Jennifer Mohlomi.
This comes after it was indicated that investigations have been completed. The state’s senior prosecutor Adv, Benny Kalakgosi provided Kula’s defence attorney Gcina Dlanjwa with an indictment in order for them to prepare for pretrial. A trial date will be decided during the pretrial.
The matter against Kula has been transferred by Klerksdorp Regional to the High Court of South Africa: North West Division, in Klerksdorp for pretrial conferencing, on 29 January 2024.
Mohlomi was found murdered on 27 November 2022, in what appeared like a robbery.
Police found her with a stab wound on her back but the object that was used for her alleged murder has not been recovered.
Mamothame indicated that the matter was reported by the medical facility where she was allegedly transported by Kula to receive medical attention.
“The accused told the police that he was not present at his home when the incident occurred. Following thorough investigations by the police, he was linked to the alleged murder and was arrested on 20 January 2023, and charged with murder,” said Mamothame.
Kula is currently out on R50 000 bail granted by the High Court of South Africa, North West Division following his appeal on the Orkney Magistrates’ Court decision to deny him bail. He tried to have the case struck off the roll and his bid was previously rejected by the court.
He was ordered to surrender his passports, report twice a day at the nearest police station, provides the investigating officer with his work itinerary, report to the investigating officer if he must move outside his residential jurisdiction, and have no direct or indirect contact with his children.
