The Special Investigating Unit (SIU) is gearing up to delve into the affairs of the Northern Cape Economic Development, Trade and Investment Promotion Agency (NCEDA). The investigation comes amidst swirling allegations of corruption and misconduct within the organization.

President Cyril Ramaphosa has given the green light for this inquiry by signing a specific proclamation that puts the focus on the agency’s workings. This directive empowers the SIU to scrutinize various aspects of NCEDA’s administrative and financial conduct.

Kaizer Kganyago, the spokesperson for the SIU, outlined the scope of this investigation, saying, “The SIU will probe allegations of corruption related to at least seven contracts and serious maladministration of salary adjustments… that were not duly authorised.”

These seven contracts encompass a range of services including legal, event management, consultancy, security, as well as the Riemvasmaak Tourism Master Plan, catering, and audio-visual provisions. The impending probe raises questions and concerns about the integrity and efficacy of procurement processes within the agency.

Furthermore, Kganyago highlighted that the investigation will “also investigate any unauthorised, irregular, or fruitless and wasteful expenditure incurred by NCEDA or the State.” The broader implications for public governance and financial responsibility are clear, with an emphasis on ensuring accountability and the lawful use of public funds.

Unlawful acts and professional misconduct are also under the microscope, “The scope of the investigation also covers any unlawful or improper conduct by officials or employees of NCEDA, the applicable suppliers or service providers or any other person or entity,” Kganyago elucidated.

A part of the SIU’s mandate is not only to sanction but also to strive for systemic change. “In addition to investigating maladministration, malpractice, corruption and fraud, the SIU will identify system failures and make systematic recommendations to improve measures to prevent future losses,” Kganyago remarked.

With a broad timeframe of investigation, from 1 March 2012 to February 2024, the inquiry may potentially lead to criminal proceedings if warranted. “In line with the Special Investigating Units and Special Tribunals Act 74 of 1996 (SIU Act), the SIU will refer any evidence pointing to criminal conduct it uncovers during its investigations to the National Prosecuting Authority (NPA) for further action,” confirmed Kganyago.

Additionally, the SIU is well-equipped with the power to initiate civil actions in order to redress any identified wrongdoings. “The SIU is empowered by the SIU Act to institute civil action in the High Court or a Special Tribunal in its name to correct any wrongdoing uncovered during its investigation caused by acts of corruption, fraud, or maladministration,” said Kganyago.
