The High Court in Pretoria has delivered a decisive blow to a doctor implicated in alleged misconduct at the National Lotteries Commission (NLC).
The court dismissed the doctor’s application, with costs, which sought to halt the Special Investigating Unit’s (SIU) investigation into the matter and demanded a change in the investigating team.
The SIU revealed that Dr. John Marite attempted to interfere with the investigation process. On September 5, 2023, Acting Judge Hein Snyman concluded that Dr. Marite’s application against the SIU amounted to an abuse of process.
According to the SIU’s corruption investigation, Dr. Marite’s company, Right Play Health Services, received approximately R7.2 million from the non-profit organization Zibsimode NPC. Zibsimode has ties to former NLC board chairperson, Alfred Nevhutanda.
Zibsimode received funding of about R20.2 million from the NLC for the implementation of a public campaign and culturally sensitive medical intervention projects aimed at promoting traditional circumcision practices. Right Play Health Services, headed by Dr. Marite, was responsible for providing the male circumcision services.
On May 31, 2017, Dr. Marite submitted an invoice to Zibsimode, resulting in a payment of R7,292,700 into the bank account of Right Play Health Services. Shortly after, Right Play Health Services transferred approximately R2,009,700 to Ironbridge Travel Agency, an entity linked to former NLC COO Phillemon Letwaba, without any evidence of work performed.
Moreover, Right Play Health Services transferred R2,013,000 to Ndzuku Trading, owned by Malwandla Solly Siweya, a party in Dr. Marite’s court application against the SIU. Siweya’s entity, Ndzuku Trading, also received three payments totaling R4.1 million from Zibsimode.
When questioned by the SIU, Dr. Marite failed to provide satisfactory responses and resorted to approaching the courts instead.
The SIU expressed satisfaction with the High Court’s ruling, characterizing Dr. Marite’s challenge as an abuse of process and an attempt to evade accountability. This ruling clears the way for the SIU to conclude its investigation into the R7.2 million received by Dr. Marite while ensuring the integrity and independence of the investigative unit.
