The Special Investigating Unit (SIU) has been mandated to investigate nine contracts at Eskom, South Africa’s state-owned power utility, following a proclamation signed by President Cyril Ramaphosa. This investigation is part of a broader effort to root out corruption and maladministration that have long plagued Eskom, contributing to its financial woes and operational inefficiencies.

- Tegeta Exploration and Resources (Pty) Limited: The investigation will probe the procurement and contracting for coal supplied by Optimum Coal Mine (Pty) Limited and the Brakfontein Colliery Mine. This contract has been under scrutiny for years, especially after it was revealed that Tegeta, linked to the controversial Gupta family, received favourable treatment from Eskom, including a substantial pre-payment.
- T Systems International GmbH: The SIU will investigate the procurement and contracting for information technology services under a master services agreement with T Systems. This contract is suspected of being overpriced and possibly awarded under questionable circumstances.
- SAP South Africa (Pty) Limited: The investigation will also delve into the procurement and contracting for information technology services related to software licence and support agreements with SAP South Africa. This contract has been linked to allegations of kickbacks paid to secure the deal.
- Task Order SM008 – “Capital Scrubbing”: This contract involves the procurement and contracting for coal services. The SIU will examine whether the services rendered were necessary and if the contracting process was conducted transparently and lawfully.
- Combined Private Investigations (Pty) Limited: The SIU will scrutinize the procurement and contracting for coal security services. This contract has raised questions about the necessity of the services provided and the manner in which the contract was awarded.
- Kapditwala Incorporated (trading as Dentons South Africa): The investigation will cover the procurement and contracting for coal forensic investigation services. The SIU aims to determine whether these services were indeed required and if they were procured following proper procedures.
- Cutting Edge Commerce (Pty) Limited (formerly Leonardo Business Consulting): The SIU will investigate the procurement and contracting for information technology services. The legitimacy and cost-effectiveness of this contract are under scrutiny.
- Pre-payment to Optimum Coal Mine: The SIU will investigate serious maladministration related to a pre-payment of approximately R1.68 billion made by Eskom to Optimum Coal Mine for coal supplied to the Hendrina Power Station. The investigation will determine whether this pre-payment was justified and if it was later converted to a guarantee.
- Pre-payment to Tegeta Exploration and Resources (Pty) Limited: Similarly, the SIU will investigate a pre-payment of approximately R659 million to Tegeta. This pre-payment has been controversial, with allegations that it was made under undue influence and without proper due diligence.
Scope of the Investigation:
The SIU has been authorised to investigate all allegations of unlawful and improper conduct by Eskom officials, employees, suppliers, service providers, or any other parties involved in these contracts. The investigation covers activities that occurred between 1 March 2006 and 30 August 2024, as well as any related activities before and after these dates that are pertinent to the investigation.
This comprehensive probe will not only focus on specific contracts but also aim to uncover systemic failures within Eskom. The goal is to identify the root causes of the corruption and maladministration that have plagued the power utility for years and recommend measures to prevent future occurrences.
Amendment to SIU’s Mandate:
In addition to the Eskom investigation, the SIU’s mandate has been expanded to cover further areas within the Department of Rural Development and Land Reform. This follows findings from the SIU’s initial investigation, which indicated the need for a broader scope to address previously uncovered issues.
The amended proclamation authorises the SIU to investigate the acquisition of several farms and assets by the Department or its beneficiaries, including:
- Bekendvlei, Nirwanda, Wonderhoek, Mont Piquet, Appelkloof, and Rietvlei farms.
- Mike’s Chicken (Pty) Limited, along with immovable assets and animals for Project Harmonie, Project Uitkyk, and Project Dipalemo.
- Shares in Bambanani Fruits BEE (Pty) Limited.
The SIU will investigate whether these acquisitions were conducted lawfully and in the best interests of the Department and the State. As with the Eskom investigation, the SIU will look into any unauthorised, irregular, fruitless, or wasteful expenditure, as well as any corrupt or improper conduct by officials, employees, or other involved parties.

The investigation into Eskom and the Department of Rural Development and Land Reform comes at a critical time for South Africa. The country is grappling with the effects of corruption and maladministration, which have severely undermined public trust in state institutions and hindered economic growth.
