“On 22 May, Masuku issued a media statement in which he again claimed that the full bench of the High Court of South Africa, Gauteng Division emphatically found that the SIU’s findings that he was involved in corruption and nepotism are devoid of merit and amounted to mere opinions. He further said that the SIU had effectively propped him as the proverbial poster boy of Covid-19 corruption,” said Special Investigating Unit (SIU) Spokesperson, Kaizer Kganyago.

Kganyago has also indicated that the criminal investigation is still ongoing. In addition, he said that the interpretation of the High Court judgement by Dr. Masuku is flawed.

“The only appropriate forum that is there for Dr Masuku to challenge the judgement of the High Court is lodge an appeal rather than continued misstatements and misleading the public,” said Kganyago.

This is after the African National Congress (ANC)’s National Disciplinary Committee (NDC) report has confirmed that the former Gauteng MEC for health Dr Masuku and suspended presidential spokesperson Khusela Diko have been cleared.

“There is no casual connection between the conduct of comrades Bandile and Khusela AND the value system and ethical framework of the ANC to support the conclusion that the comrades acted in an unethical manner and, consequently, were guilty of contravening Rule 25.17.4 of the ANC constitution,” said ANC NDC Chairperson, Mildred Oliphant.

Masuku reacted to the ANC NDC report by saying the SIU had ‘effectively propped him as the proverbial poster boy of Covid-19 related corruption.

“On the 12 April 2021, a full bench of the North Gauteng High Court per Sutherland J emphatically found that the SIU’s findings (dubbed opinions by the Court) that I was involved in corruption and nepotism are devoid of merit,” said Dr Masuku.

Masuku went to suggest that he is a disciplined member of the ANC, who compiled with all the requirements of the internal disciplinary inquiry.
