The Judicial Service Commission (JSC) has initiated a public consultation process regarding the appointment of the nation’s next Chief Justice and Deputy President of the Supreme Court of Appeal. This comes ahead of the vacancy that will arise at the end of August following the conclusion of Chief Justice Raymond Zondo’s tenure.

President Cyril Ramaphosa has put forward Deputy Chief Justice Mandisa Maya for the position of Chief Justice along with the nomination of the Chairperson of the Electoral Court, Justice Dumisani Zondi, for Deputy President of the Supreme Court of Appeal.

“Deputy Chief Justice MML Maya and Justice DH Zondi have accepted the nomination and on 22 March 2024 submitted the required questionnaire for Judges and all the standard documents required of persons who seek to be appointed as Judges,” the JSC articulated in an official statement.

In a bid to ensure transparency and inclusivity in the selection process, the JSC is reaching out to legal bodies, members of the public, and other institutions to provide their insights on the nominees.

“Law bodies, members of the public, and other interested institutions are invited to make written submissions on the suitability or otherwise of the President’s nominees for appointment as Chief Justice and Deputy President of the SCA respectively, and any other relevant information relevant to the selection process,” the commission emphasised.

Those wishing to participate in the consultation can submit their comments to the Secretariat of the JSC via email at MMondlane@judiciary.org.za and TPhaahlamohlaka@judiciary.org.za, with a copy to JSC@judiciary.org.za. It is crucial for submissions to be organised separately for each nominee and to reach the JSC by no later than 02 May 2024, as late comments will not be taken into account.

The JSC also disclosed plans to interview the nominees in sessions open to public observation. Dates, timings, and venues for these interviews will be announced to ensure media and public participation, underscoring an approach of openness and accountability in the judicial appointment process.
