SAMWU Calls for Dismissal of Matjhabeng Mayor Following Assault Conviction

The South African Municipal Workers’ Union (SAMWU) in the Free State has called for the immediate dismissal of Matjhabeng Local Municipality Executive Mayor, Thanduxolo Khalipha, following his recent conviction on three counts of assault and crimen injuria by the Odendaalsrus Magistrate’s Court. SAMWU’s demand for accountability follows a disturbing incident in February 2024, where Mayor Khalipha allegedly assaulted his own bodyguard during a community meeting in Odendaalsrus. SAMWU’s statement emphasised the need for leaders who respect the rule of law, declaring that “no one, regardless of rank or authority, is above the law.”

Background of Mayor Khalipha’s Conviction

Mayor Thanduxolo Khalipha’s conviction is rooted in a community engagement session that took a violent turn on 28 February 2024. During the meeting at Kutlwanong High School, tensions escalated when community members began pelting stones at the mayor’s vehicle, shattering its rear window. In the ensuing chaos, Mayor Khalipha allegedly attacked his bodyguard, leading to charges of common assault and crimen injuria.

The court found him guilty on three counts: assault with the intention to cause grievous bodily harm, crimen injuria, and attempting to defeat the ends of justice. Mayor Khalipha’s sentencing is scheduled for 12 December 2024, with his bail extended until then.

SAMWU’s Call for Immediate Dismissal

SAMWU Free State Provincial Secretary Thabang Tseuoa issued a statement condemning Mayor Khalipha’s conduct as an “unacceptable abuse of power.” Tseuoa emphasised that Khalipha’s actions have eroded the trust between public officials and municipal workers, compromising the dignity and safety of employees. SAMWU has demanded the mayor’s immediate removal from both his councillor and mayoral roles, citing his behaviour as detrimental to the municipality’s reputation.

SAMWU’s statement reflects a broader frustration with the lack of accountability among public officials. The union highlighted that Khalipha’s leadership has contributed to the erosion of essential services in Matjhabeng, leaving communities deprived of basic support. SAMWU reiterated its commitment to “standing for positive change” and to advocating for leaders who prioritise the welfare of workers and the communities they serve.

Reactions from the Democratic Alliance (DA)

The Democratic Alliance (DA) has also welcomed the court’s verdict and expressed support for SAMWU’s demand for Khalipha’s resignation. The DA’s Constituency Head for Matjhabeng Municipality praised the judgement as a “victory for accountability and the rule of law.” The DA has reiterated its call for Mayor Khalipha to step down, arguing that his actions are incompatible with the standards expected of a public official.

The DA has warned that, should Mayor Khalipha refuse to resign, it will introduce a motion of no confidence in the council, a move that could lead to a vote for a change in leadership within the Matjhabeng Local Municipality. The DA’s statement reflects a growing push for ethical governance and adherence to the law within the municipality.

The EFF’s Response and Criticism of ANC’s Handling of the Case

The Economic Freedom Fighters (EFF) in the Free State have voiced strong support for Khalipha’s removal, condemning both his actions and the ANC’s handling of the matter. In a scathing statement, the EFF claimed that the ANC’s provincial leadership, led by Mxolisi Dukwana and Pulediso Motsoeneng, delayed taking action against Khalipha despite the severity of the allegations.

The EFF accused the ANC of allowing Khalipha to remain in his position for over seven months without enforcing the step-aside rule. According to the EFF, the ANC initially advised Khalipha to take leave rather than suspending him, a decision the EFF criticised as disregarding the legal recommendations that Khalipha had breached the councillors’ code of conduct by assaulting a municipal employee.

The EFF vowed to pursue Khalipha’s removal not only as mayor but also as a councillor, asserting that a criminal record should disqualify an individual from holding any public office. The EFF emphasised its commitment to “a clean and corrupt-free government,” pledging to support credible leadership in Matjhabeng.
