President Cyril Ramaphosa has publicly shared his profound grief over the passing of Justice Yvonne Mokgoro, a retired Constitutional Court Justice and revered member of the Order of the Baobab. Justice Mokgoro passed away on Thursday, 9 May 2024, succumbing to injuries sustained in a tragic car accident after a prolonged illness. She was 73.

The President conveyed his and the government’s heartfelt condolences to Mokgoro’s husband, Prof Job Mokgoro, her family, and a wide circle of friends and colleagues within the South African and international legal communities. The loss has deeply affected those who knew her and worked alongside her throughout her illustrious career.

Justice Mokgoro’s journey is one of historical and inspirational milestones. She was a trailblazer, becoming the first black woman to serve on the Constitutional Court of South Africa from its foundation in 1994 until she concluded her term in 2009. Her academic roots were firmly planted in the then University of Bophuthatswana (now North West University) where she earned her Bachelor of Jurisprudence in 1982, followed by her LLB and LLM degrees. Her thirst for knowledge led her to the University of Pennsylvania in the USA, where she achieved a second LLM degree in 1990.

Her professional life was dedicated to the pursuit of justice, human rights, and the transformation of South Africa’s legal landscape. As a judge, she navigated complex legal terrain with wisdom and compassion. Mokgoro’s contributions extended beyond the courtroom; she was a celebrated academic, imparting her vast knowledge to students in South Africa and abroad. Her work focused on uplifting society, especially women and children, through the law.

Justice Mokgoro’s remarkable contributions to law and justice were recognized in 2015 when she was awarded the Order of the Baobab in Bronze. This accolade is a testament to her unwavering commitment to building a just and democratic South Africa.

Reflecting on her passing, President Ramaphosa highlighted Justice Mokgoro’s role as a critical figure in the birth of South Africa’s democracy, particularly referencing Nelson Mandela’s appointment of Mokgoro to the Constitutional Court. As a representation of societal transformation, her contributions to juridical reform and her involvement in various advisory capacities have left an indelible mark.

“Her insightful and principled counsel lives on in the thousands of legal careers she shaped in the course of her academic endeavours,” President Ramaphosa remarked.
