Ramaphosa Authorises SIU to Investigate 2018 Refurbishment and Security Contracts at Vaal University of Technology

President Cyril Ramaphosa has authorised the Special Investigating Unit (SIU) to investigate two critical contracts at the Vaal University of Technology (VUT) dating back to 2018, as part of a broader crackdown on alleged maladministration and corruption within South Africa’s public institutions. The newly signed Proclamation 217 of 2024 empowers the SIU to probe the university’s procurement and contracting processes, focusing specifically on contracts related to the refurbishment of student residences and campus security services. This investigation underscores the government’s commitment to accountability and transparency within the higher education sector and its dedication to ensuring the proper use of public funds.

SIU’s Mandate and Scope of the Investigation
Under Proclamation 217 of 2024, the SIU will focus on two main contracts awarded by VUT in 2018. These contracts pertain to the refurbishment of student residences and the provision of campus security and protection services. The SIU’s mandate includes examining whether these contracts were awarded in compliance with principles of fairness, transparency, competitiveness, and cost-effectiveness. The investigation also aims to identify any potential violations of legislation, guidelines, and procedures set forth by the National Treasury.

The investigation period spans from 1 January 2016 to 8 November 2024, with provisions to include relevant incidents occurring before or after these dates if they involve the same entities or individuals associated with the contracts. The SIU’s thorough approach allows for a comprehensive examination of any historical or ongoing irregularities that may have affected VUT’s procurement integrity.

Key Focus Areas of the SIU Investigation at VUT

1.  Refurbishment of Student Residences

The refurbishment of student residences has been a priority for universities across South Africa, particularly as higher education institutions face an increasing demand for student housing. The SIU’s investigation will seek to determine whether the refurbishment contract awarded in 2018 was handled in compliance with regulatory standards. It will assess if the procurement process adhered to the principles of fairness, transparency, and cost-effectiveness, as stipulated by the Public Finance Management Act (PFMA).
2. Campus Security and Protection Services
Security on university campuses is another crucial issue, given the growing need to ensure student safety. The SIU’s investigation will focus on the 2018 security services contract at VUT, assessing whether the university’s procurement process for these services was conducted transparently and equitably. Ensuring that campus security contracts are awarded fairly is essential for protecting both students and university resources.
3. Compliance with Treasury Regulations and Legislation
In addition to examining the specific contracts, the SIU will scrutinise VUT’s overall adherence to procurement guidelines established by the National Treasury. This includes evaluating whether VUT officials and other stakeholders complied with relevant legislation, guidelines, and policies. If any irregularities or fraudulent activities are uncovered, the SIU will take appropriate action to address these issues and recommend improvements to prevent future occurrences.

Background on the SIU’s Broader Mandate

The authorisation for this investigation is part of a larger effort by President Ramaphosa’s administration to address corruption, maladministration, and financial mismanagement across various sectors. Proclamation 217 is just one of several new mandates that the President has issued, empowering the SIU to investigate multiple government entities and municipalities. Other investigations include probes into the South African Special Risk Insurance Association (SASRIA) concerning claims related to the July 2021 unrest, as well as investigations into procurement irregularities within the Gauteng Department of Health, Mahikeng Local Municipality, and Alfred Nzo District Municipality.

SIU’s Authority Under the Special Investigating Units and Special Tribunals Act

The SIU operates under the Special Investigating Units and Special Tribunals Act 74 of 1996, which grants it extensive powers to investigate and litigate cases of corruption, fraud, and maladministration within public institutions. Under this Act, the SIU is not only empowered to conduct thorough investigations but also to institute civil proceedings in the High Court or a Special Tribunal. This authority allows the SIU to recover funds lost due to improper conduct and to hold individuals or entities accountable for their actions.

Additionally, any evidence of criminal conduct uncovered during the investigation will be referred to the National Prosecuting Authority (NPA) for further legal action. This partnership between the SIU and NPA ensures that cases of corruption are not only exposed but also prosecuted, providing a strong deterrent against future misconduct.
