In a recent address to the nation, President Cyril Ramaphosa commended the significant progress that has been made in implementing the government’s plan in response to the recommendations put forth by the State Capture Commission.
As the two-year anniversary of the final public hearing of the commission approaches, President Ramaphosa underscored the efforts of the National Prosecuting Authority (NPA), the Hawks, and other institutions in coordinating investigations and prosecutions.
With the commission having issued 205 investigative and prosecutorial recommendations, President Ramaphosa provided updates on the ongoing legal proceedings. Currently, nine cases involving 41 accused individuals and 12 companies are before the courts.
Furthermore, freezing orders totaling R13 billion have been granted to the NPA, and a substantial R5.4 billion has been traced and returned to the state. Moreover, evidence presented to the State Capture Commission has also led to the recovery of unpaid taxes by the South African Revenue Service.
Beyond these immediate measures, President Ramaphosa highlighted the extensive legislative and institutional changes being pursued to reduce the potential for corruption. Eight out of the 14 new laws or legislative amendments identified in the implementation plan have been approved by Cabinet and tabled in Parliament.
These laws address crucial areas such as public procurement, the involvement of politicians in administrative matters, the conduct of public servants, the intelligence services, money laundering, and electoral reforms.
Additionally, six draft laws are currently undergoing public consultation with stakeholders, with further research being conducted on other recommendations, such as criminalizing the abuse of political power.
To enhance transparency in procurement processes and the appointment of boards and executives at state-owned enterprises (SOEs), the draft Public Procurement Bill and SOEs bills are in the pipeline. These initiatives aim to instill accountability and prevent future corruption.
President Ramaphosa also expressed gratitude towards the individuals and organizations that exposed state capture, acknowledging the role of whistleblowers.
He emphasized the importance of protecting whistleblowers and outlined recommendations for their safeguarding, including criminalizing threats against them, creating a fund for those dismissed due to their disclosures, and providing state protection when necessary.
