The Passenger Rail Agency of South Africa (PRASA) board has reinstated Zolani Kgosietsile Matthews as the Group Chief Executive Officer (GCEO). This decision follows a ruling by the Labour Court on 1 July 2024, which upheld the validity of Matthews’s contract, initially terminated by the PRASA board in December 2021.

Background of the Termination

The termination came after an investigation by a seasoned senior counsel, who sought to determine whether Matthews had deliberately and intentionally failed to disclose material information regarding his dual citizenship. Despite these allegations, the Labour Court found that Matthews’s contract remained valid, leading to his reinstatement.

Arbitration and Reinstatement

Following the termination, retired judge Robert Nugent ruled in arbitration proceedings that PRASA should reinstate Matthews with back pay. PRASA, however, applied to the Labour Court to review Nugent’s ruling. The Labour Court’s recent decision has now paved the way for Matthews’s return to his role as GCEO.

PRASA’s Response to the Judgment

In response to the judgment, PRASA issued a statement indicating its next steps: “Considering this decision, PRASA is now in the process of engaging Zolani Matthews to discuss the implications of the judgment. The organisation respectfully requests time and space to engage with Mr Matthews accordingly. The PRASA Board of Control remains committed to discharging its duties with the utmost diligence.”
