Optimum Coal Mine Settles Over R6 Million in Licensing Debt Following SIU Probe

The Optimum Coal Mine – a company with past ties to the controversial Gupta family – has cleared over R6.9 million in overdue motor vehicle licensing fees and penalties. This repayment is part of an Acknowledgement of Debt (AoD) the mine signed with the SIU, which was disclosed on Tuesday .

The probe by the powerful SIU, which was sparked by allegations of corruption and maladministration, meticulously scrutinised the dealings within the national and provincial Departments of Transport. The investigation’s sharp focus was to unravel any improprieties in the realm of vehicle registration, ownership, and licensing, particularly non-payment issues related to such.

“The SIU’s investigation focused on any conduct by officials or agents of the department or any other person which relates to the registration of motor vehicle ownership and licensing details and non-payments of motor vehicle licensing fees, arrears and penalties,” stated the SIU in their recent media communiqué.

Through diligent examination of records held by the Department of Transport and the Road Traffic Management Centre, along with data from the Electronic National Administration Traffic Information System (eNatis), the SIU deduced that a debt of R6 914 304.52 was owed to the Department by Optimum Coal Mine.

Spokesperson for the SIU elaborated on the investigation’s outcome: “The SIU analysed the information obtained from the Department of Transport and Road Traffic Management Centre, as well as the eNatis data. After sifting through the eNatis data, the SIU established that the Department is owed the sum of R6 914 304.52 in respect of the trucks and smaller vehicles owned by Optimum.”

While the mine’s action to clear its debt marks a victory for the SIU, the unit made it clear that this would not shield the company or individuals from other legal pursuits that could follow. “The recovery of the funds from Optimum does not exempt other legal processes from being actioned,” it cautioned.

The SIU, demonstrating its might and mandate, reaffirmed its capability to haul offenders before civil courts, including the High Court or a Special Tribunal, to rectify injustices unravelled during investigations. Additionally, any evidence hinting at criminal contrivance is referred to the National Prosecuting Authority, ensuring that perpetrators could still face their day in court.

“In line with the Special Investigating Units and Special Tribunals Act 74 of 1996, the SIU refers any evidence pointing to criminal conduct to the National Prosecuting Authority (NPA) for further action,” the anti-corruption unit warned.
