NPA Vows to Reinstate Estina Dairy Farm Case After Court Strikes It Off Roll

The National Prosecuting Authority Investigating Directorate (NPA ID) has committed to reinstating the Estina dairy farm case “as soon as possible.” This follows a decision by the Free State High Court to strike the matter off the court roll.

Defence Challenges and State’s Preparedness

NPA spokesperson Advocate Mthunzi Mhaga explained that the case was struck off the roll after the defence applied under Section 342 A of the Criminal Procedure Act. The defence cited their “inability to access the electronic version of the hard copies of the so-called Gupta leaked emails” as the reason for their application.

However, Mhaga pointed out that the State had provided the defence with hard copies of the Gupta leaked emails “as early as 2023” as part of the disclosure process. Additionally, on 15 June 2024, the defence was given electronic versions of these hard copies. The State also offered a technical expert to help the defence access the digital platform if they encountered any challenges.

NPA’s Commitment to Justice

Despite the court’s decision, the NPA maintains that it was prepared to proceed with the case. Mhaga emphasized, “Since the trial date of 5 August 2024, the State has been ready to proceed, with witnesses ready to testify in court.”

The ID team has been working under the guidance of experienced Senior Counsel who have diligently covered all aspects of the Gupta evidence and relevant disclosures. Mhaga asserted that the NPA is undeterred by the court’s decision and is committed to pursuing justice in this matter.

“The NPA will reflect further on today’s decision; however, the NPA remains undeterred in the pursuit of this matter and will take all necessary steps to reinstate it,” Mhaga concluded.

Background of the Estina Dairy Farm Case

The Estina dairy farm case is a significant corruption trial involving allegations of massive fraud and money laundering linked to the Gupta family. The project was intended to empower local farmers in the Free State but allegedly saw millions of rands diverted to the Gupta family and their associates.

The NPA’s determination to reinstate the case underscores its commitment to holding those involved accountable and ensuring that justice is served.
