Pretoria, Gauteng – Political analyst Moses Kau has dismissed the Economic Freedom Fighters (EFF)’s perjury case against Police Minister Senzo Mchunu’s Chief of Staff, Cedric Nkabinde, as a move more for show than substance, arguing it lacks proof of intentional lying. Kau’s comments come after EFF Deputy Secretary General Leigh-Ann Mathys announced plans to open the case on Thursday, 13 November 2025, at the Cape Town South African Police Service station. The accusation stems from Nkabinde’s testimony before Parliament’s Ad Hoc Committee investigating police corruption, where he allegedly gave false statements about meeting dates with businessman Brown Mokgotsi. Kau says the errors on dates do not meet the legal bar for perjury, which needs clear intent to mislead, and notes Nkabinde was advised to use approximate dates due to uncertainty.
This clash highlights growing tensions in the committee’s probe, where claims of corruption and interference in law enforcement are being aired. As the EFF pushes for accountability, Kau’s view suggests the case may not hold up, potentially affecting how such allegations are handled in future.
Kau’s Analysis of the EFF’s Perjury Claim
In a detailed statement, Kau broke down why he sees the EFF’s case as weak. He defined perjury as an “intentional and unlawful act of making a false statement under oath,” covering both spoken and written words. Kau holds no side for Nkabinde but says where wrong, he should face results.
Kau pointed out Nkabinde’s missteps were about dates, and he told the committee he was not sure of them. “The man’s misrepresentations are about dates, and he has indicated to the Ad-Hoc Committee that one, he was not sure of dates, two, he indicated that to the Evidence Leader, Advocate Norman Arendse, SC, and he was advised to give approximate dates,” Kau explained. He argued this shows no intent to lie, a key part of perjury.
Kau noted Nkabinde’s gadgets, like his phone and laptop, were taken by investigators, which could back his claim of relying on memory for dates. “The fact that his gadgets (possibly mobile phone, ipad, laptop) have been appropriated by the Investigators, counts in his favour as unlike me who still believes in the actual paper, most of the people out there, have based their whole being on electronic gadgets,” Kau said.
He also said the committee’s choice to let Nkabinde go and come back later shows they see room to fix his affidavit. “The decision of the Ad Hoc Committee to release him and give him another date to appear before the Committee, confirms the view that I hold. They have given him the opportunity to go and amend (correct) his affidavit,” Kau added.
Kau ended by questioning the EFF’s legal advice: “EFF, where are your in-house Legal Advisors.”
Background to the Ad Hoc Committee and Nkabinde’s Testimony
The Ad Hoc Committee is looking into claims of corruption in the criminal justice system, sparked by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi’s statements about rogue elements. Nkabinde testified as Mchunu’s Chief of Staff, but his affidavit had wrong dates about meetings with Mokgotsi, who is linked to other probes.
The EFF says Nkabinde lied, leading to the session’s halt. They plan to open the perjury case at 17h00 on Thursday in Cape Town. This follows similar moves, like against former Crime Intelligence head Dumisani Khumalo.
The committee has heard from many, including Batohi, who faced heat for not naming corrupt prosecutors. Malema pushed her hard, saying she answers like someone retiring.
