MK Party Says Zuma Will Challenge ANC Expulsion Amid Claims of Unfair Process

Johannesburg  – The Umkhonto we Sizwe Party (MK Party) has announced that former President Jacob Zuma will challenge the ANC’s disciplinary process following his expulsion from the party. The MK Party expressed profound shock and dismay upon learning from media sources about an alleged leak from the ANC National Disciplinary Committee (NDC) regarding the ruling.

In a media statement released on 29 July 2024, the MK Party declared, “Umkhonto we Sizwe Party (MK Party), and on behalf of President Jacob Zuma, expresses profound shock and dismay upon learning from media sources about an alleged leak from the ANC National Disciplinary Committee. The leak pertains to a ruling that reportedly announces the expulsion of President Jacob Zuma. We can only confirm this as an act that appears to be a deliberate attempt by the ANC of Ramaphosa to undermine President Zuma.”

Controversial Expulsion and Allegations

The MK Party highlighted that neither President Zuma nor his designated representative, Comrade Tony Yengeni, were informed of the ruling, describing it as “a stark violation of both the ANC Constitution and the Constitution of South Africa.” The party stressed the foundational legal principle that no individual should be punished or sentenced in their absence, a principle designed to protect against miscarriages of justice.

The ANC’s National Executive Committee (NEC) initiated disciplinary proceedings against Zuma after he publicly endorsed the MK Party ahead of the 29 May elections. The issue began on 16 December 2023, when Zuma expressed dissatisfaction with the ANC and announced his intention to vote for the MK Party in the 2024 general elections.

Flawed Disciplinary Process

The MK Party’s statement criticised the disciplinary process as “profoundly flawed” and likened it to a “kangaroo court.” The statement noted that the ANC initially scheduled a physical hearing in May but later withdrew this commitment. It also detailed alleged intimidation tactics employed by Fikile Mbalula against Comrade Yengeni, further questioning the integrity of the process.

Allegations of Political Intimidation

The MK Party condemned the ANC’s behaviour as synonymous with tactics used during apartheid, stating, “This leak is not an isolated incident but the climax of a series of repressive actions that disturbingly echo tactics once used during apartheid.” The statement added that the current ANC leadership under Ramaphosa and its coalition partners, the DA, seemed to have drawn inspiration from these tactics.

In response to the expulsion, President Zuma will engage his legal team to determine the course of action and ensure justice is served. The MK Party asserted, “Umkhonto we Sizwe will not passively watch as these grave injustices against its leader unfold. President Zuma will engage his legal team to urgently determine the course of action and ensure that justice is served. Upon the conclusion of consultations, President Zuma will announce further actions based on the guidance of these consultations.”

ANC’s National Disciplinary Committee Verdict

According to a leaked document from the ANC’s NDC, Zuma was found guilty of contravening the ANC Constitution by acting in collaboration with the MK Party, a political organisation not in alliance with the ANC. The NDC’s final verdict expelled Zuma from the ANC, granting him the right to appeal the decision within 21 days.

In a letter to NEC members, Fikile Mbalula, the Secretary-General of the ANC, confirmed the expulsion and outlined the NDC’s findings, stating, “The charged member is expelled from the ANC. The charged member has the right to appeal to the National Disciplinary Committee of Appeal within 21 days.”

Call for Transparency and Fairness

The MK Party’s statement concluded with a call for transparency and fairness, urging the ANC to live up to the rights and values enshrined in the Constitution of South Africa. The party remains steadfast in its support for President Zuma and his right to a fair and just disciplinary process.
