Mashinini Appeal Withdrawn by ANC Free State

Bloemfontein – The African National Congress Provincial Secretary in the Free State province, Paseka Nompondo has confirmed that the Provincial Executive Committee (PEC) in the province will no longer proceed with the appeal filed with the Constitutional Court via a letter to Moroka Attorneys.

“This letter serves to inform yourselves that the ANC FS PEC is not proceeding with the appeal,” said Nompondo.

This is after the Free State African National Congress Provincial Executive Committee (PEC) members have filed legal papers in the Constitutional Court, to challenge last month’s Supreme Court of Appeal (SCA) ruling declaring the governing party’s 2018 provincial conference unlawful and unconstitutional.

According to the provincial secretary of the ANC, Nompondo, the decision to withdraw the appeal is an instruction given by the national leadership of the ANC. “The ANC National Officials as well as the National Working Committee have directed the PEC that this matter be resolved through political and organisational processes and not through legal processes,” said Nompondo.

In addition, Nompondo has indicated that his provincial chairperson Sam Mashinini did not have the power and was not deployed by the ANC to file an affidavit on behalf of the PEC.

“You are further requested to revert back to us by no later than 13:00 today (22nd April 2021) with confirmation that you have executed the above instructions.”

Meanwhile, the South African Communist Party (SACP) in the Free State province confirmed that they are shocked to learn of an appeal filed with the Constitutional Court by ‘certain individuals.’

“Whilst the SACP respects the rights of every individual, we firmly believe that in the context of enhancing the unity and renewal of the ANC in the province,” said SACP Provincial Spokesperson Phillip Kganyago.

SACP leadership in the province says it will engage and urge the African National Congress Provincial Executive Committee to abandon the appeal and focus their energy towards the building of unity and reclaiming ANC processes outside of court.

Meanwhile, the SACP says that the deployment of the former president Kgalema Motlanthe by the ANC national leadership indicates the seriousness of the organisation in wanting to achieve unity.

The African National Congress (ANC) National Working Committee has recently appointed former president Kgalema Motlanthe to find a political solution to factional battles in the Free State province.
