A man has been sentenced to 15 years imprisonment for defrauding the Unemployment Insurance Fund and unduly benefitting from the COVID-19 Temporary Employer/ Employee Relief Scheme (TERS). Dennis Patrick Lerato Modika was found guilty on eight counts and sentenced in the Johannesburg Specialised Commercial Crimes Court.

Modika submitted 1,358 fictitious employee claims over a two-year period, resulting in the Department of Labor paying over R5 million to a bank account belonging to him and his company. TERS was meant to assist businesses affected by the national lockdown during the pandemic.

The National Prosecuting Authority (NPA) praised Senior State Advocate Frans Mhlongo and Investigating Officer, Warrant Officer Siralile for ensuring that the abuse of the relief fund did not go unpunished.

In court, Advocate Mhlongo argued for a harsh sentence, stating that it should reflect not only the looting of the UIF coffers but also the hardship and suffering imposed on the rightful recipients. He also emphasized that Modika was more concerned with his own pleasure than the welfare of others.

The NPA welcomes the sentence and hopes it serves as a deterrent for others who may consider defrauding relief funds.
