LIVE : Moti Group in Court to Fight Against Amabhungane over Stolen Documents

Today, the eyes of the South African legal system are focused on a historic court battle between the Moti Group and Amabhungane.

The stakes could not be higher, as South African businessman Dondo Mogajane and his Moti Group team of lawyers stand up to defend the company against allegations of theft and defamation by investigative journalism non-profit Amabhungane.

At the heart of the dispute is a set of stolen files that were obtained by Clinton van Niekerk, a former employee of the Moti Group. If Van Niekerk was in fact a whistleblower, he would have handed the documents over to higher powers before handing them over to disgruntled business partners and then after that, to AmaBhungane. Amabhungane, then subsequently released a series of articles painting Moti Group founder, Zunaid Moti and his businesses in a negative light.

Van Niekerk only pleaded as a whistleblower after he was arrested months later.

The Moti Group has argued that the use of these stolen files by Amabhungane is a violation of their right to privacy, and constitutes a breach of journalistic ethics.

The campaign against Zunaid Moti and Moti Group has been fierce, with major news outlets such as News24, AmaBhungane and Daily Maverick publishing numerous articles maligning the company and its owner. However, the Moti Group has maintained its legal position, and has continued to fight back against what it sees as a smear campaign aimed at damaging its reputation and business interests.

As the court battle gets underway, all eyes will be on the arguments presented by both sides. The Moti Group will argue that the use of stolen files by AmaBhungane represents a serious breach of journalistic ethics, and that any resulting articles should be considered as defamatory. Meanwhile, AmaBhungane will defend its actions, arguing that they were justified in using the stolen files.

Only time will tell how this historic case will unfold, but one thing is certain – the eyes of the nation will be watching closely.
