Minister of Justice and Constitutional Development, Thembi Simelane, is set to appear before Parliament’s Portfolio Committee on Justice and Constitutional Development this week following serious allegations linking her to the VBS Mutual Bank scandal. These accusations have raised concerns about her integrity and the broader implications for South Africa’s efforts to combat corruption.
Background on Allegations
Last week, reports emerged that Simelane allegedly received a loan of R575,600 from Gundo Wealth Solutions, a company owned by Ralliom Razwinane, who is currently on trial for his role in facilitating illegal investments from municipalities into the now-defunct VBS Mutual Bank. Simelane, who was the Mayor of Polokwane Municipality at the time, is accused of using this loan to purchase a coffee shop in Sandton. The timing and circumstances of this loan have led to speculation that it may have been a kickback related to Polokwane Municipality’s substantial deposits into VBS.
Parliamentary Committee Inquiry
The chairperson of the Portfolio Committee on Justice and Constitutional Development, Xola Nqola, expressed the committee’s concern over the damaging nature of these allegations. The committee, tasked with upholding the integrity of South Africa’s legal system, has summoned Simelane to address these claims directly. Nqola emphasized that such allegations harm the public’s perception of South Africa’s commitment to eradicating corruption.
Simelane, during a recent question and answer session in the National Assembly, committed to appearing before Parliament, stating that she is ready to take Parliament and the South African public into her confidence regarding these allegations.
President Ramaphosa’s Response
In response to these allegations, President Cyril Ramaphosa has requested a detailed report and briefing from Simelane on the matter. The Presidency expressed concern over the potential implications these allegations could have on public trust in governance and the rule of law. The President’s call for clarity underscores the seriousness of the situation, particularly given Simelane’s role in overseeing the country’s justice system.
Political Reactions and Civil Society Involvement
Political parties and civil society organizations have been vocal about the need for accountability. The Economic Freedom Fighters (EFF) have called for Simelane’s immediate resignation, arguing that her continued tenure could compromise the integrity of the justice system. ActionSA has gone further, lodging a complaint with the Public Protector, demanding an independent investigation into the matter.
Civil society organizations, including Freedom Under Law and the Ahmed Kathrada Foundation, have issued statements urging Simelane to fully and transparently address these allegations. They highlighted the broader issue of compromised individuals holding significant positions within the government, which they argue, continues to erode public confidence in South Africa’s institutions.
ANC’s Position
ANC Secretary-General Fikile Mbalula has confirmed that Simelane will also face the ANC’s Integrity Commission to explain her involvement in the VBS scandal. Mbalula noted that the ANC is committed to its renewal process and that any actions that contradict the party’s stance against corruption will be scrutinized. He reiterated the party’s expectation for a comprehensive report from Simelane, stressing that such matters cannot be ignored in the party’s ongoing efforts to restore public trust.
