Julius Malema, the leader of the Economic Freedom Fighters (EFF), has declared support for “Please Call Me” inventor Nkosana Makate and issued a strong warning to Vodacom Group Limited regarding its intention to escalate their legal battle to the Constitutional Court of South Africa. This follows after the Supreme Court of Appeal dismissed Vodacom’s appeal in Makate’s favor on Tuesday.

Malema voiced his concern via social media on Wednesday, asserting that the mobile communications company must cease its avoidance of responsibility. “What started as a simple transactional dispute between two parties has now become a national irritation because they think they can bully him. Appealing to the ConCourt to fight the SCA ruling in favor of Makate is entirely unnecessary. Please don’t say we are not nice people, be warned,” Malema articulated.

Malema called for meditative paths rather than legal battles. “It is important to call for mediation right now if Vodacom truly has good intentions. The track record of former Chief Justice Langa, former Chief Justice Mogoeng, and former DCJ Moseneke suggests that one can be an impartial mediator. Vodafone must immediately remove their failed VodacomSA CEO to prevent further loss of reputational damage,” he continued.

Malema highlighted the importance of fair treatment, solidarity, and the imperative to resolve the issue within the year. “The manner in which you are treating an African brother with arrogance is unacceptable and will not be tolerated any longer. This issue will be resolved by the end of this year, don’t ask how, but it will be resolved this year. Please note that if you have a solution to offer, you must contact Makate directly and not me,” the leader concluded.

The legal odyssey turned in Makate’s favor on Tuesday when the Supreme Court of Appeal decreed that Vodacom owes Makate a remuneration reflecting a percentage of revenues from the “Please Call Me” service. As per the SCA, this amount falls between 5% and 7.5% over an 18-year period, along with the pertinent interest. The directive offers Vodacom a 30-day window to compute and extend a fair settlement to Makate.

Vodacom’s reaction to the judgment revealed their dismay as they prepare to appeal to the Constitutional Court. “Vodacom is surprised and disappointed with the judgment and will bring an application for leave to appeal before the Constitutional Court of South Africa,” the company stated.

At stake is the potential overturn of the North Gauteng High Court’s ruling that mandated a hefty 27% of revenue share to be Makate’s due reward. The Supreme Court’s recent move dismissed Vodacom’s attempt to appeal and ordered CEO Shameel Joosub to revisit the compensation offer to Makate, aiming for a resolution that beats the initial R47-million proposed, which Makate has persistently deemed insufficient against his call for a compensation in the tens of billions.
