Johannesburg City Manager Floyd Brink has found himself at the centre of a legal storm following a failed attempt to serve a warrant for his arrest after he did not comply with a court order that prevented the city from disconnecting utilities.

On Wednesday, an attempt by the court sheriff to execute the warrant on Brink hit a roadblock as the city argued that the warrant was fraught with errors making it legally unenforceable. This incident has sparked a wave of criticism from various political quarters, with the Democratic Alliance (DA) in Johannesburg voicing its deep concerns over the adherence to the rule of law within the City of Johannesburg (CoJ).

“We have received credible information indicating that the arrest of CoJ City Manager, Floyd Brink, has been unduly delayed due to, among other factors, the presence of thirteen unmarked vehicles outside his residence in Roodepoort,” the DA stated. They further lambasted the governing coalition in Johannesburg for its role in what they describe as a “deeply entrenched crisis,” highlighting the absurdity that a clerical error on the arrest warrant further hinders Brink’s arrest.

Brink’s legal troubles stem from a contempt of court order connected with a case involving the illegal disconnection of a resident’s services, highlighting a broader issue of governance and service delivery within the city. The DA’s statement lamented the current state of affairs, stating, “It is a sad day that police worked against law and order… These actions by police make them part of our corruption problem.”

Johannesburg Mayor Kabelo Gwamanda has defended Brink, arguing that the attempt to serve the warrant at his private home was an invasion of his and his family’s rights. He emphasised that any action, if justified, should have been taken at Brink’s office rather than his home. “The city manager has been the target of incessant harassment by certain political actors using the courts to compromise and prevent him from exercising his duties,” Gwamanda remarked, condemning the motives behind the action as an effort to tarnish Brink’s reputation and intimidate his family.

In response to the unfolding drama, Gwamanda has directed the city’s legal team to file an urgent application to halt the warrant’s execution, viewing it as an unjust use of the legal system to target city officials.

Furthermore, the city has pledged to continue its efforts to settle disputes over rates and utility accounts amicably and transparently, inviting residents to engage with its dispute resolution mechanisms.
