Jacob Zuma Issues Qualified Apology to Western Cape High Court Over MK Party Statements

Leader of the uMkhonto weSizwe (MK) Party, Jacob Zuma, has issued a qualified apology to the Western Cape Division of the High Court, following the court’s sharp criticism of the party’s past remarks. The MK Party had previously attacked the judiciary, calling a court ruling “incompetent, irrational, and absurd”, after its parliamentary leader, Dr. John Hlophe, was barred from serving on the Judicial Service Commission (JSC).

However, while Zuma acknowledged the court’s concerns, his apology was carefully worded, stating that the party’s leadership was not responsible for drafting the contentious statements and only sought to express disagreement with the judgment.

Despite Zuma’s partial apology, the Democratic Alliance (DA) has indicated that it is not satisfied and reserves its right to pursue contempt of court proceedings against Hlophe and the MK Party.

Background: Why the MK Party Clashed With the Judiciary

✔ The Western Cape High Court temporarily barred Dr. John Hlophe from serving on the Judicial Service Commission (JSC), citing his impeachment as a judge.
✔ The MK Party reacted strongly, calling the court’s judgment “irrational” and an “affront to justice”.
✔ In December 2024, the court dismissed the MK Party’s application for leave to appeal, criticizing its remarks as “contemptuous, aggressive, and unconstitutional”.

The court warned that such attacks on the judiciary were an attempt to undermine public confidence in the rule of law.

Zuma’s Apology: A Strategic Move?

✔ Zuma distanced the MK Party leadership from the controversial statements, claiming they did not draft the remarks.
✔ He admitted that some statements may have been offensive to the judiciary, and for that, he extended an apology.
✔ However, Zuma did not retract the MK Party’s stance, maintaining that the party fundamentally disagrees with the ruling against Hlophe.

His statement attempts to appease the judiciary without fully conceding wrongdoing, a move that political analysts describe as a tactical attempt to prevent legal consequences.
