By Thys Khiba – The High Court of South Africa North West Division; North West Division is expected to pronounce the judgement on the African National Congress (ANC) MP Sibusiso Kula’s bail application within seven days.
This comes after the High Court decided to issue a notice for 23 March 2023, for Kula to appeal the bail judgement.
This comes after his first appeal on the bail judgement was struck off the roll as submitted papers were not in order.
The first appeal on the bail judgement was also struck off the roll at the High Court of South Africa, North West Division, as his application was not in order.
“Senior state Adv. Benny Kalakgosi has prepared heads of argument to oppose the application.
“An application has been submitted to the office of the Director of Public Prosecutions in North West, Dr Rachel Makhari, for the matter to be transferred to a higher court, owing to its serious nature,” said North West NPA spokesperson Henry Mamothame.
Adv. Kalakgosi argued for the state in persuading the court not to grant Kula bail, after the Orkney Magistrates’ Court denied him bail, after being charged for allegedly murdering his wife.
His legal representative also argued for him to be granted bail.
Judge Andre Petersen indicated that he will apply his mind and consider all arguments and supporting documents presented in court before passing judgment.
Meanwhile, the Orkney Magistrates’ Court in the Matlosana local Municipality has postponed the matter against Kula to 17 April 2023, for further investigations.
An application has been submitted to the office of the Director of Public Prosecutions in North West, Dr Rachel Makhari, for the matter to be transferred to a higher court, owing to its serious nature.
Kula was charged with allegedly murdering his wife and the court denied him bail in his last court appearance.
This comes after he was arrested on Friday, 20 January 2023 in connection with the killing of his wife.
“Following thorough investigations by the police, he was linked to the alleged murder, and he was arrested on Friday, 20 January 2023, and charged with murder,” Mamothame.
According to SAPS reports, Kula’s wife was found murdered on 27 November 2022, in what seemed like a robbery.
Jennifer Mohlomi (31) was found with a stab wound on her back but the object that was used for her alleged murder has not been recovered.
The matter was reported by the medical facility where she was allegedly transported by the Kula to receive medical attention.
“He told the police that he was not present at his home when the incident occurred.”
Police investigations are still underway, and Kula is expected to remain in police custody until the next court appearance.
