The Hawks’ KwaZulu-Natal Crime Against The State unit has arrested Bonginkosi Khanyile, 34, for contravening the Riotous Assemblies Act and conspiracy to commit public violence, stemming from events that occurred in Johannesburg in March 2024. The arrest took place on 16 August 2024, highlighting the ongoing crackdown on individuals inciting violence and unrest in South Africa.

Khanyile, a former uMkhonto weSizwe (MK) Party youth leader, has been a controversial figure, particularly after his public declarations earlier this year. In March, during a press briefing in Johannesburg, Khanyile made incendiary remarks threatening that the May national and provincial elections would not proceed if former President Jacob Zuma or the MK Party were barred from contesting. His statements, which included a call to “declare war” if his demands were not met, were seen as a direct incitement to public violence, echoing the unrest that South Africa experienced in July 2021.

The Directorate for Priority Crime Investigation (Hawks) acted on these threats, arresting Khanyile as he appeared in Durban Magistrate’s Court for a separate case related to the July 2021 unrest. According to Hawks spokesperson Colonel Katlego Mogale, Khanyile’s announcement in March was intended to instigate South Africans to protest and engage in violent acts across the country if his conditions regarding the elections were not fulfilled.

The arrest of Khanyile has sparked significant reactions on social media, with South Africans expressing mixed opinions. While some have celebrated the arrest, viewing it as a necessary step to maintain law and order, others have criticised the Hawks’ actions, questioning whether the charges against Khanyile are politically motivated.

Khanyile, who has been released on bail, is set to reappear in the Durban Magistrate’s Court on 23 September 2024 to face both the current charges and those related to his previous incitement of violence during the 2021 unrest.
