Former Athletics SA Acting CEO Repays Lottery Funds

Terrence Magogodela, the former Acting Chief Executive Officer of Athletics South Africa (ASA), has made restitution of the monies he improperly acquired from the National Lotteries Commission (NLC). The Special Investigating Unit (SIU) disclosed that Magogodela consented to return a sum of R388,733.05 following findings that he fraudulently diverted funds earmarked for athletic facility development in the Northern Cape towards the purchase of a personal real estate property.

Detailed investigations by the SIU unearthed that Magogodela had deceitfully listed himself as the project coordinator for the non-profit organisation, Inqaba Yokulinda, on an application for funding. However, investigations revealed inconsistencies. “On the form, he indicated that he was the project coordinator for Inqaba Yokulinda, but he was neither the project coordinator nor a member of [non-profit organisation] Inqaba Yokulinda,” the SIU commented.

Magogodela’s dubious dealing involved submitting a funding application alongside a business and implementation plan, coupled with an endorsement letter from ASA, to the NLC, before redirecting the secured funding towards a personal property acquisition in Gauteng.

This breach of trust led the SIU to initiate actions to reclaim the misappropriated funds. “Initially, a settlement agreement was reached but Magogodela failed to honour it. This prompted the SIU to approach the Special Tribunal for an application to preserve his Gauteng home,” SIU remarked, shedding light on their course of legal action that culminated in the Special Tribunal granting a preservation order for Magogodela’s property in February 2022.

The subsequent repayment by Magogodela appears to have temporarily mitigated the immediate financial discrepancies but doesn’t serve as a blanket immunity against potential criminal charges. The SIU has made it clear that notwithstanding the complete restitution of funds, the settlement attained does not exempt Magogodela from facing likely prosecution for his actions.

Further elaborating on the implication of the settlement, the SIU said, “The settlement agreement does not constitute a full and final settlement between the parties. SIU remains entitled to join Magogodela in any future proceeding and claim appropriate relief from him.”
