Expelled MK Party Members Challenge Ousting in Western Cape High Court

Ten members of the uMkhonto weSizwe (MK) Party are set to contest their recent expulsion from Parliament in the Western Cape High Court today. These members, ousted on 7 August 2024, are challenging the legitimacy of their dismissal, claiming that their resignations were fabricated to create vacancies for incoming members of the Economic Freedom Fighters (EFF), including prominent figures like Floyd Shivambu.

According to court papers, the expelled members argue that their termination was executed unlawfully and did not adhere to the MK Party’s internal protocols. The group, which includes MPs such as Thamzanqa Kuzwayo, Isaac Menyatso, and Nomado Mgwebi, alleges that the party’s leadership, under the direction of former President Jacob Zuma, orchestrated their ousting to pave the way for political realignment within the National Assembly.

The members assert that they were never involved in any resignation process and maintain that their positions in Parliament should be restored. Their legal team has filed an urgent application to prevent Parliament from swearing in their replacements, pending the outcome of the court proceedings. They argue that their dismissal not only violates procedural fairness but also jeopardizes their livelihoods, as many left previous employment to serve as MPs.

This legal battle highlights the ongoing instability within the MK Party, which has faced allegations of internal misconduct and external influences. The party’s leadership has responded by stating that all internal processes were followed, and the expulsions were necessary to maintain the integrity of the party’s parliamentary representation. However, the expelled members are determined to challenge what they see as a politically motivated purge, further deepening the divisions within the party.
