Employment and Labour Minister Condemns Compensation Fund Fraud as Six Plead Guilty in Major Scam

Employment and Labour Minister Nomakhosazana Meth has condemned the fraudulent siphoning of funds from the Compensation Fund, following the guilty pleas of six individuals involved in a scam that redirected payments to personal accounts using fictitious medical providers.

The minister reaffirmed the department’s commitment to accountability and anti-corruption measures in a statement issued on Saturday, 17 August 2025. This conviction serves as a strong warning that fraud against vulnerable workers will not be tolerated, with ongoing efforts to strengthen systems and pursue justice.


Guilty Pleas Highlight Organised Crime in Social Protection System


In a significant blow to fraudsters targeting government resources, six members of the so-called Capitec Group pleaded guilty on 16 July 2025 in the Pretoria Specialised Commercial Crimes Court. The individuals—Phumzile Ivy Ngubane (48), Thuleleni Joyce Ngubane (44), Delisile Constance Ngubane (62), Busisiwe Brenda Masango (43), Gunther Nsibande (51), and Nhlanhla Mkhabela—admitted to violating the Prevention of Organised Crime Act by assisting in benefiting from unlawful proceeds.

They misrepresented themselves as legitimate medical providers to divert Compensation Fund payments intended for workers’ injury claims into their own bank accounts.
The scam involved creating fake medical service providers not registered with regulatory bodies, allowing the group to intercept funds meant for occupational injury and disease compensation. Prosecutors described it as a sophisticated operation that exploited vulnerabilities in the claims process, siphoning unspecified amounts—though similar cases have involved hundreds of thousands of rands. Sentencing is scheduled for 3 November 2025, where the court will consider the scale of the fraud and its impact on public trust.


These six are part of a larger group of nine arrested in late 2024, with three others still facing trial. The arrests followed investigations by the department’s Integrity Management unit, in collaboration with law enforcement agencies like the Hawks and the National Prosecuting Authority. This case underscores the risks in digital claims processing, where inadequate verification can lead to exploitation.


Minister Meth’s Strong Stance Against Fraud on Vulnerable Workers


Minister Nomakhosazana Meth issued a scathing condemnation, describing the fraud as a criminal assault on workers and their families who rely on the Compensation Fund for support during times of need. “The Compensation Fund exists to support workers with occupational injuries or diseases during their employment. Fraud is a criminal assault on vulnerable workers and their families, who depend on these funds for livelihood and dignity,” Meth said. She praised the collaborative efforts of her team’s Integrity Management unit, prosecutors, law enforcement, and the judiciary for delivering justice.


Meth highlighted the fund’s role in providing financial aid, medical care, and rehabilitation to employees injured or ill due to work-related incidents. Established under the Compensation for Occupational Injuries and Diseases Act, it covers millions of workers across sectors like mining, construction, and manufacturing, where risks are high. However, fraud erodes resources meant for genuine claims, delaying payments and undermining the system’s integrity.


The minister’s statement comes amid broader concerns about corruption in South Africa’s social security systems. The Compensation Fund has faced criticism for audit failures and fraud risks over the past decade, as noted in parliamentary reports. In 2024, the Auditor-General flagged irregular expenditures exceeding R1 billion, prompting calls for reforms. Meth’s response signals a zero-tolerance approach, building on previous convictions to deter future crimes.


Enhanced Measures to Combat Fraud and Strengthen Accountability
To prevent similar incidents, the department is implementing robust anti-fraud strategies. These include:

  • Enhanced monitoring and auditing systems to detect irregular transactions in real-time.
  • Collaboration with medical regulatory bodies, like the Health Professions Council of South Africa, to verify providers and claims.
  • Introduction of an advanced digital platform to automate claims processing, reducing human intervention and errors.
  • Partnerships with law enforcement for swift investigations and prosecutions when fraud is suspected.
    Meth emphasised that these steps will create a practical, sustainable regulatory framework. “The department, with help from law enforcement, will pursue and hold accountable anyone defrauding the fund,” she said. This builds on past successes, such as the 2018 conviction of three former Compensation Fund employees who defrauded over R476,000 through fake claims, receiving prison sentences up to 12 years.
    The minister called on the public, workers, and employers to join the fight against corruption in labour-related institutions. “We must continue efforts to clean up and safeguard our social protection systems,” Meth urged, linking it to broader goals of dignity and support for the workforce.
