The Johannesburg High Court has struck off the urgent application filed by ANC MP Boy Mamabolo on Tuesday, dismissing the case on the grounds of lacking urgency. Mamabolo had hoped to challenge the ANC’s decision to adjust his position in the party’s 2024 candidate list, seeking reinstatement to his original ranking.

The core of Mamabolo’s application revolved around his attempt to overturn the ANC’s decision which saw his name descend from the fifth position in the provincial to the national list down to the 25th spot—a move he has attributed to internal factionalism within the party. Documents revealed in court highlighted allegations from Mamabolo that Electoral Committee Secretary Chief Matsila had pressured him to align with a specific faction within the ANC, a claim that adds a layer of intrigue to the proceedings.

However, the ANC, in its court submissions, has painted a different picture. The party asserts that Mamabolo’s demotion was a result of procedural shortcomings, notably his failure to provide a matric certificate and raising concerns over the authenticity of his qualifications as a paralegal.

Further complicating matters, the ANC’s court filings question the legitimacy of Mamabolo’s academic credentials, revealing that he has yet to submit evidence of both his matriculation and a law diploma from the University of Johannesburg (UJ)—qualifications proudly listed on his CV.

Kgoshi Thobejane, the ANC provincial list committee chairperson in Limpopo, expressed doubts regarding Mamabolo’s capacity to serve as a legal adviser given the scant evidence of completed legal education.

“No one can have a post-matric qualification without first passing matric,” Thobejane stated, underscoring the gap between Mamabolo’s claims and his documentation.

Mamabolo, for his part, has branded the accusations regarding his academic qualifications as “rubbish,” standing firm on his position. Detailed in his pursuit for justice, Mamabolo articulates a narrative of political manipulation orchestrated to sideline him, stressing the detrimental impact his removal from the list could have on his minor children.
