In the latest legal development involving the founder of the Umkhonto we Sizwe (MK) Party, Jabulani Khumalo, the North Gauteng High Court has ordered Standard Bank to remove Khumalo as a signatory to the MK Party’s bank account. This follows Khumalo’s attempt to remain a signatory on the basis that he was appealing his expulsion from the Jacob Zuma-led MK Party. The court also imposed a cost order on Khumalo, requiring him to pay the MK Party’s legal fees for the case, adding to a series of legal defeats he has faced in his ongoing battle with the party.

A Series of Legal Losses

This recent judgment adds to the mounting legal setbacks Khumalo has faced. Over the past months, he has made multiple attempts to challenge his expulsion from the MK Party and reclaim leadership positions, all of which have been unsuccessful.

In June 2024, Khumalo suffered a significant defeat when the Electoral Court dismissed his urgent application to be reinstated as the MK Party’s leader. Khumalo had alleged that his signature had been forged in documents that transferred leadership to former President Jacob Zuma. However, the court found no merit in his claims, describing the application as “frivolous” and an abuse of court processes. The court also ruled that Khumalo’s allegations lacked credibility and imposed punitive costs on him, adding a financial blow to his legal woes .

In another case, Khumalo’s attempt to be sworn in as a Member of Parliament for the MK Party was also struck off the roll by the Western Cape High Court, which found that his case lacked urgency. This followed the MK Party’s decision to remove him from its parliamentary list, a move Khumalo attempted to reverse through legal channels but ultimately failed .

Khumalo’s Dispute with Jacob Zuma

Khumalo’s legal troubles began after his expulsion from the MK Party in early 2024, when Jacob Zuma was officially recognized as the party’s leader. Khumalo has since mounted multiple legal challenges against his ousting, claiming that Zuma’s leadership is illegitimate and that he was unlawfully removed from his position. Despite these claims, the courts have consistently ruled against him, with judges citing contradictions in his arguments and a lack of substantive evidence .

Implications of the High Court Ruling

The recent North Gauteng High Court ruling, which orders Standard Bank to remove Khumalo as a signatory on the MK Party’s bank account, further isolates him from the party’s operations. The account in question reportedly receives donations, and Khumalo’s removal represents a significant loss of influence within the party’s financial structure.

This ruling, combined with the court’s order for Khumalo to cover the MK Party’s legal costs, underscores the financial and reputational toll his legal battles have taken. The court’s decision highlights Khumalo’s diminishing standing within the party, and it raises questions about his next move, given the string of defeats he has faced.
