On Tuesday, former Cape Town Human Settlements Mayoral Committee Member (MMC) Malusi Booi was granted bail of R250,000 by the Cape Town Magistrate’s Court. This follows his arrest, alongside nine co-accused, in connection with a R1 billion tender fraud case involving the City of Cape Town’s Human Settlements Directorate. Booi and his co-accused face serious charges, including fraud, money laundering, racketeering, and corruption.

Details of the Arrest and Charges

Malusi Booi, the former MMC and Democratic Alliance (DA) councillor, was arrested on September 9, 2024, following a long-standing investigation into fraudulent activities linked to the allocation of housing tenders within the City of Cape Town. The tenders, valued at over R1 billion, were allegedly awarded unlawfully to companies with connections to the notorious 28s gang boss, Ralph Stanfield.

The charges against Booi and his associates are severe, with the group facing accusations of operating a corrupt network that laundered money through fraudulent contracts. These illegal contracts were reportedly linked to eight housing projects under the City’s Human Settlements Directorate .

The Court’s Bail Decision

The Cape Town Magistrate’s Court ruled that Booi would be released on bail, setting the amount at R250,000. Magistrate Alida Theart presided over the case, noting that the accused would be prohibited from contacting any witnesses involved in the case. Additionally, strict conditions were attached to Booi’s bail, including restrictions on his movement outside the Eastern Cape, where he currently resides. He is also required to surrender his passport and provide full disclosure of any intended travel to the investigating officer .

While the bail conditions appear strict, public reaction to the decision has been mixed. Many South Africans took to social media to express their frustration, with some questioning why bail was granted in such a high-profile corruption case .

Reaction from the Public and Political Figures

The decision to grant Booi bail has sparked outrage among many citizens, particularly on social media, where netizens voiced their disapproval. Some critics believe that the bail amount of R250,000 is insignificant, given the magnitude of the alleged crime and Booi’s financial resources. One commentator remarked that “Prison is for the poor and unknown,” while others suggested that the law seemed to favour the wealthy and well-connected .

Political reactions have been equally strong. The African National Congress (ANC) welcomed Booi’s arrest but raised concerns about the ongoing tender corruption within municipalities. Meanwhile, the DA distanced itself from Booi, emphasizing that his actions do not reflect the values of the party .
