The Commissioner of Correctional Services, Makgothi Samuel Thobakgale, announced that he will determine former President Jacob Zuma’s medical parole matter by next week Thursday (10 August 23).

Earlier this year, the Constitutional Court dismissed an attempt to challenge the Supreme Court of Appeal’s ruling on Zuma’s release on medical parole. Consequently, Zuma is required to return to prison. In December 2021, the Pretoria High Court reviewed and overturned former Correctional Services Commissioner Arthur Fraser’s decision to grant Zuma medical parole.
Despite the commissioner’s subsequent unsuccessful appeal in the Supreme Court of Appeal last November and the recent dismissal of the bid by the Constitutional Court, the ruling remains in effect. Both the commissioner’s office and Zuma personally applied to the Constitutional Court, seeking intervention, but their appeal was promptly dismissed due to its lack of reasonable prospects of success.
The Supreme Court of Appeal’s ruling mandates Zuma’s return to prison. However, the question of whether the time he spent on medical parole should be deducted from his sentence remains unresolved. This decision now lies with the current acting commissioner, Makgothi Thobakgale, who has temporarily assumed the role.
As the deadline approaches, the public and interested parties await Thobakgale’s decision, which will ultimately determine the fate of former President Jacob Zuma in relation to his sentence.
