By Thys Khiba – On Tuesday, C-Squared Group have instructed their legal representatives and attorney to file an application for leave to appeal the judgement handed down by the High Court of South Africa Free State Division, Bloemfontein Judge PJ Loubser.
“We are also of the strong belief, respectfully, that the order handed down by the Honourable Judge was factually incorrect and incongruent with prescripts of the law. As such, we have instructed our attorneys of record to immediately file an application for leave to appeal the whole order, this was done this morning – and the application will be heard by the Court in due course,” said C-Squared in a statement.
C-Squared told the public that the festival will continue as planned.
This comes after the Mangaung African Cultural Festival(MACUFE) tender declared unlawful and set aside by the High Court.

“The First and Second Respondents are ordered to pay the costs of the application jointly and severally, the one paying the other to be absolved,” reads judgement.
The High Court indicated that due to time constraints, the reasons for these orders will be made available on Thursday, 06 October.
The legal matter is between DS Consortium and MEC for Sports, Arts, Culture and Recreation Limakatso Mahasa, and C-Squared Group Pty Ltd.
A joint venture between Dots Design Group Pty Ltd and Sonaqua Events and Promotions CC launched an urgent court application against the MEC for awarding the Macufe tender to C-Squared.
DS Consortium announced to seek a personal cost order against Mahasa should the event go ahead. They also have accused the Mahasa of distorting the court’s order by saying that Judge Loubser indicated that the festival must go ahead.
It was reported that C-Squared Consumer Connectedness has won R16 849 863.80 to organise the 2022 Macufe.
