Free State Premier Maqueen Letsoha-Mathae

On 15 November 2024, the Free State Provincial Government made an urgent appeal to the public to stop sharing or circulating a leaked image of Premier MaQueen Letsoha-Mathae following her recent medical procedure. The Provincial Government deemed the act a severe violation of her privacy and a contravention of the Protection of Personal Information Act (POPIA). Acting Premier Jabu Mbalula strongly condemned the circulation, stating it was “not only unethical but also undermines her right to dignity and privacy, as protected by our Constitution.”
Government Condemns Breach of Privacy
Free State Provincial Government Spokesperson Setjhaba Maphalla addressed the issue, calling on the public to refrain from further sharing the image. “This image is a blatant invasion of the Premier’s privacy and contravenes POPIA,” said Maphalla, reiterating the legal implications for those involved. Acting Premier Mbalula emphasized that the public must respect the Premier’s recovery, adding, “We appreciate the public’s interest in the Premier’s well-being, but we must balance this with respect for her privacy.”
This incident raises broader questions about the ethical responsibilities of South Africans when engaging in online activities, especially regarding sensitive content.
Mounting Political Pressure and Corruption Allegations
The controversy comes amid increasing political tension in the province. Premier Letsoha-Mathae’s temporary leave of absence coincides with escalating corruption allegations against her and her husband, Mr Bongani Mathae, Speaker of the Mangaung Metro. These allegations have prompted the Democratic Alliance (DA) to prepare a motion of no confidence.
Roy Jankielsohn, Leader of the Official Opposition in the Free State Legislature, alleged that the Premier was forced to take leave due to “advanced criminal investigations” related to corruption. “While the Provincial Government cites medical reasons, internal ANC sources indicate that this leave is linked to corruption allegations,” Jankielsohn stated.
The DA has submitted an affidavit to the Directorate of Priority Crimes (Hawks), accusing the Premier and her husband of receiving financial benefits from a roads contractor. Should formal charges be laid, Jankielsohn affirmed that the DA would consult other opposition parties to pursue a motion of no confidence.
Opposition Parties Voice Disapproval
The Economic Freedom Fighters (EFF) have also condemned the situation, questioning the legitimacy of the Premier’s leave and Acting Premier Jabu Mbalula’s appointment. EFF Free State Provincial Chairperson Mapheule Liphoko argued, “The Premier has used this loophole to avoid stepping down from office while facing corruption charges.”
The EFF further criticized Mbalula’s appointment, describing him as “the defiled brother of the Secretary General of the ANC, Fikile Mbalula,” and labelling the decision “an insult to the people of Free State.”
Similarly, ActionSA has filed formal charges against the Premier and her husband, alleging irregularities in a multi-million-rand tender process involving construction projects. These accusations highlight a growing opposition movement against the Premier’s leadership.
ANC and Provincial Government Respond
Amid the growing uproar, the African National Congress (ANC) Free State branch defended the Premier’s actions. Provincial Secretary Polediso Motsoeneng dismissed claims that the Premier was instructed to take leave, calling such allegations “shameful.” He stated that the leave was strictly for health reasons and expressed confidence in Acting Premier Mbalula’s ability to lead.
In an official statement, the Provincial Government clarified that Letsoha-Mathae’s absence was temporary and that Mbalula would serve as Acting Premier until mid-December. The swearing-in ceremony, conducted by Judge President Cagney John Musi, was described as procedural.
Premier Letsoha-Mathae issued her own statement, assuring the public of her confidence in Mbalula’s leadership. “I have full confidence that Acting Premier Mbalula will ensure the continued progress and prosperity of our province during this period, whilst having the full support of the Executive and officials of government,” she said.
Investigations and Allegations: The Bigger Picture
Premier Letsoha-Mathae’s tenure has been shadowed by multiple controversies. Investigations by the Hawks are probing claims that the Premier and her husband benefited financially from contracts awarded to New Beginnings Projects, a company allegedly linked to irregular activities. Contractor Patrick Phuti alleged that he provided financial support to the Premier and her husband, deepening suspicions of corruption and money laundering.
In addition, over 1,300 contract workers were dismissed last month under the Premier’s watch, raising concerns about governance practices in the province. Opposition parties have cited these actions as evidence of systemic mismanagement.
Public Protector’s Role
The office of the Public Protector in the Free State has confirmed that it is assessing complaints filed by opposition parties against the Premier. A preliminary investigation will determine whether the allegations fall under its jurisdiction. The office has promised to issue a response within ten working days.
Privacy in the Digital Age
The circulation of the Premier’s leaked image underscores critical issues surrounding digital privacy and ethics. Under POPIA, sharing such content without consent violates the law, subjecting those responsible to legal action. Legal experts have warned that individuals who distribute the image could face fines or imprisonment, depending on the severity of the breach.
In a society where information spreads rapidly online, Acting Premier Mbalula’s plea highlights the need for greater awareness and responsibility. “This is a time for empathy and understanding, not exploitation,” he remarked, calling on citizens to consider the human impact of their actions.
