Man arrested for window breaking incident at Constitutional Court

By Thys Khiba – The North West Division of the High Court has handed down three life terms to Bafana Johannes Mans (26) for kidnapping, double rape and murder of 4-year-old Tshimologo Lotshabeng, in Vryburg on Wednesday. 

The triple life imprisonment has been welcomed by the South African Police Service (SAPS) and the National Prosecuting Authority (NPA) in the North West province.

This comes after police managed to arrest Mans at his residential place in Jan Kempdorp in the Northern Cape. On Sunday, 16 May 2021, the lifeless and naked body of Tshimologo was found in the bushes at Kgomotso village, near Taung. 

“According to evidence presented before the court, Mans, was a colleague and one of the people who accompanied Tshimologo’smother from a tavern to her friend’s the. He waited until the mother fell asleep, then kidnapped the child and took her to the nearby bushes where he raped and killed her,” said policespokesperson, Colonel Adele Myburgh. 

The convict was denied bail upon his first court appearance on Monday, 24 May 2021 and kept in police custody.

The Prosecutor Advocate Xolisile Philisane told the court not to deviate from the minimum prescribed sentence as the offence was committed on a helpless minor. 

He continued to argue that Mans did not show any remorse for his actions. The accused failed to a stand and apologise to the family of Tshimologo.

Myburgh, indicated Mans was sentenced as follows: 

Count 1: Murder: Life Imprisonment

Count 2: Rape: Life Imprisonment

Count 3: Rape: Life Imprisonment

Count 4: Kidnapping: Five years imprisonment. The sentence in count two, three and four is expected to run concurrently.

The provincial Director of Public Prosecutions, Dr Makhari-Sekhaolelo and police Provincial Commissioner Lieutenant General Sello Kwena praised the SAPS and NPA for their efforts that led to the conviction. 

Kwena directly commended the Investigating Officer, Colonel Kgosi Dihemo and the Prosecutor, Advocate Xolisile Philisanefor their tireless and joint efforts, and indicated that this will serve as a deterrence to those who violate and take innocent lives of women and children.
