Marikana Massacre | Case against 17 miners removed from court roll

By Phenyo Selinda

On the 12th anniversary of the tragic Marikana massacre, Justice and Constitutional Development Minister, Thembi Simelane, reaffirmed the government’s unwavering commitment to addressing the claims and grievances stemming from this dark chapter in South Africa’s history. Speaking at a media briefing on Friday, Simelane highlighted the government’s efforts in disbursing R352 million in compensation to the victims and families affected by the tragedy, underscoring the ongoing pursuit of justice for those who suffered.

The Marikana Massacre: A Tragic Reminder

The Marikana massacre remains one of the most harrowing events in post-apartheid South Africa, marking a day of violence that shocked the nation and the world. On 16 August 2012, 34 mineworkers employed at the Lonmin platinum mine in Marikana, North West, were shot dead by police during a strike demanding a salary increase to R12,500 per month. This event, now etched into the nation’s collective memory, is a stark reminder of the struggles and sacrifices made by workers in their fight for better living conditions.

The tragedy was preceded by several days of escalating tension, which saw ten people, including police officers and security guards, lose their lives in the violent clashes that led up to the fateful day. The massacre has since been the subject of intense scrutiny, legal battles, and demands for accountability, both from the government and the broader South African public.

Government’s Commitment to Justice

During the recent briefing at the Government Communication and Information System (GCIS) in Pretoria, Minister Simelane described the anniversary as a “sombre chapter in the nation’s history that continues to resonate deeply”. She detailed the government’s efforts to provide compensation to the victims’ families and the injured or arrested mineworkers, noting that about R352 million has been disbursed so far.

“This reflects our ongoing efforts to ensure that those affected receive the compensation they are due,” Simelane stated, emphasising the government’s dedication to resolving the remaining aspects of the Marikana matter. However, she acknowledged that certain issues, particularly the constitutional damages, are still pending before the Gauteng High Court.

Simelane reassured the public that the government remains committed to finalising these matters and ensuring that justice is served, highlighting the importance of addressing each case individually to ensure compensation aligns with legal frameworks and court directives.

Engaging with Stakeholders

In the weeks leading up to this milestone anniversary, Minister Simelane and her department have been actively engaging with management and branch heads to gain a detailed understanding of the operational challenges and opportunities within the justice sector. These meetings have also included consultations with various entities reporting to the department, with the aim of preparing for the new administration and enhancing the department’s capacity to deliver justice.

“We are grateful for the messages of support and constructive advice from various organisations and institutions within the justice cluster,” Simelane said, acknowledging the valuable insights gained from these engagements. She noted that these contributions will be instrumental as the department works to uphold and promote fair justice practices in South Africa.

The Special Tribunal’s Role in Fighting Corruption

In addition to the efforts surrounding Marikana, Minister Simelane reiterated the government’s commitment to combating corruption through the work of the Special Tribunal. Established in 2019, the Tribunal has played a pivotal role in recovering state funds lost to corruption, with an estimated R15 billion successfully reclaimed to date.

Simelane announced that the Presidency would soon reveal the names of the Judges who will serve on the Special Tribunal, ensuring that the Special Investigating Unit (SIU) has the necessary judicial support to continue pursuing cases of corruption and malfeasance.
